Cancellation Policy: A cancellation fee of $50 will apply on all accepted registrations. There is no refund for cancellations made less than 7 days prior to the start of the course. PARENTAL CONSENT AND RELEASE FOR THE USE OF SAILING DINGHIES OR ESCORT BOAT BY MINORS I am the parent or legal guardian of the “Minor” and I am completing this consent and release for myself and on behalf of the Minor, and I have due and sufficient legal authority to do so. In consideration of allowing the Minor to utilize the Maple Bay Yacht Club (“MBYC”) facilities, dinghies, escort boats and other equipment, I acknowledge and agree as follows: 1. The Minor is permitted to sign out and skipper, crew or otherwise ride in, travel upon or utilize one of MBYC’s sailing dinghies or an escort boat under unsupervised conditions and any other related activity (the “Activities”). 2. The Minor is physically, emotionally and mentally capable of the Activities and he or she is able and willing to take instructions and follow any policies or guidelines that may be issued by MBYC, from time to time, including but not limited to those contained in the MBYC Bylaws and Member Handbook. I have explained to the Minor these policies and guidelines and he or she has understood the importance of following such instructions. 3. The Activities are undertaken and assumed entirely at the sole risk of the Minor with no qualification or condition, and MBYC takes no responsibility for any action, claim, damages, expense, cost or matter arising therefrom. I acknowledge and agree that the Activities can be hazardous with certain inherent risks that are unavoidable and cannot be mitigated in any way by MBYC and its officers, directors, members, employees, agents or other present or participating persons. These risks include but are not limited to: a. human error; b. boat or collisions with other vessels and third parties; c. unpredictable or rapidly changing weather conditions; d. mechanical failure; or e. other unforeseeable circumstances or events, and that, amongst other things, hypothermia, drowning, damage to personal property, injury or death may occur due to such circumstances. By signing this release I acknowledge that I am waiving certain legal rights that the Minor or his or her next of kin, successors, heirs and assigns (the “Minor Parties”) may have against the MBYC Parties. I further understand and agree that this release is binding upon the Minor and the Minor Parties. I do hereby fully and unconditionally release, remise, forever discharge and agree not to sue MBYC and its officers, directors, members, employees, agents, successors and assigns (“MBYC Parties”) for and from any and all causes of action, suits, proceedings, expenses, contracts, damages, claims and demands, whatsoever, which the Minor have or may have against MBYC Parties for or by reason of any matter, cause or action done or omitted to be done by MBYC Parties arising out of the Activities, including but in no way limited to negligence, gross negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under the Occupiers Liability Act or at common law, whether caused by the negligence, actions or omission of the MBYC Parties or otherwise. I agree to save harmless and keep indemnified the MBYC Parties from and against all claims, action costs, expenses, demands in respect to death, injury, loss, damage to person or property, however caused arising out of or in connection with the Activities notwithstanding that the same may have been contributed to, caused or occasioned by the negligence of the MBYC Parties.
